Terms of Sale & Use
Last updated November 2026
These terms apply when you use this website, buy photos from our shop, or subscribe to our client app. "We", "us" and "our" means New Light Media. By buying from us or using our services you agree to these terms.
1. Prices and payment
Prices are in Australian dollars and include GST where applicable. Payments are processed securely by our payment provider, Stripe; we never see or store your full card details.
We may change our prices at any time, but changes don't affect orders you've already paid for.
2. Buying photos from our shop
When you buy a photo you receive a digital download of the full-resolution image, without the watermark.
We email you a download link straight after payment. The link works for 30 days — please download and keep your photos somewhere safe. If you have trouble downloading, email us at [email protected] and we'll help.
Photos shown in our shop carry a watermark and are for previewing only; they may not be downloaded, screenshotted or used.
3. Your licence to use purchased photos
We (or the photographer) keep the copyright in every photo. When you buy a photo, we grant you an ongoing, non-exclusive licence to use it to promote yourself, your team and your sponsors, including:
- posting it on social media and websites — including paid and sponsored social media advertising;
- promotional and marketing material for you, your team, your sponsors and partners (for example sponsor posts, announcements and results graphics);
- printing it for yourself, your team or as a gift.
A credit or tag (@New Light Media) is appreciated wherever practical.
You may not sell, license or give the photo itself to others to use as their own (for example as stock imagery), put it on products for sale (such as merchandise or prints) without our written permission, remove our watermark from shop previews, or use it in a way that is unlawful or misleading. Clients using photos under a separate agreement or subscription are licensed under that arrangement.
4. Client app subscriptions
Subscriptions are billed in advance, monthly or annually, and renew automatically until cancelled.
You can change or cancel your plan at any time from Plan & billing in the app. When you change plans the difference is calculated for the rest of the billing period: moving to a plan that costs more is charged to your card straight away (and the change only goes ahead once that payment succeeds), and moving to one that costs less is credited on your next invoice. When you cancel, your plan continues until the end of the period you've paid for and isn't renewed.
If a payment fails we'll try again and let you know; if it can't be collected, access to paid features may be reduced until it's resolved.
Plan features, limits and perks (such as free or discounted shop photos) are as described on our pricing page at the time, and may change with reasonable notice.
5. Refunds
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. If a photo you bought is faulty, can't be downloaded, or isn't what was shown, we'll replace it or refund you.
Because photos are digital and delivered immediately, we don't otherwise offer refunds for change of mind. To ask about a refund, email us at [email protected].
6. Photography and videography bookings
You can request coverage for an event in the client app. A request isn't a booking until we accept it. The price shown when you request (including any plan discount) is what you'll pay; if we need to change it, we'll send you a new price to approve first. Quotes we send you in the app are valid until the date shown on them.
For paid bookings, we charge your saved card when we accept your request. If a payment needs extra confirmation or fails, the booking isn't confirmed until it's paid.
You can cancel a booking in the app. If you cancel more than 48 hours before the event starts, we'll refund you in full. Cancellations within 48 hours of the event aren't refunded, because we've already committed a photographer to it. If we have to cancel, or can't cover an event we've accepted, we'll refund you in full.
If the event itself is called off or postponed, get in touch and we'll work with you on a fair outcome, such as moving the booking to the new date.
Bookings made outside the app are provided under the quote or agreement we give you for that booking, which sets out what's included, delivery times, licensing and payment.
7. Content you upload and connect
You keep ownership of what you upload to the client app, such as logos, sponsor artwork, fonts, photos and data. You confirm you have the right to use it, including your sponsors' permission to use their logos and branding, and you give us permission to store, copy, resize, edit (for example removing backgrounds or adding watermarks) and display it, only as needed to provide our services to you.
If you connect another service (such as a store or a data feed), you authorise us to read the information we need from it to make your graphics. You can disconnect it at any time.
You're responsible for the graphics and posts you make and publish from the app, including what they say and meeting any obligations to your sponsors or your sport's governing body.
Photos and video fans send you through Fanshots come to you under the terms the fan agrees to when they send them. Please use them within those terms.
If you give photographers an upload link, you're responsible for who you give it to and for what they send. Their photos come to you under the contributor terms they accept before their first upload; any other arrangement you have with them (such as payment or wider rights) is between you and them.
We may remove content that breaks these terms or the law.
8. Ending your subscription or account
When a subscription ends, your account moves to our free plan (or, if there isn't one, paid features stop). Your photos, galleries, files and templates stay in your account, so you can pick up where you left off if you subscribe again.
To close your account and have your files deleted, email us at [email protected]. We'll delete or anonymise your account and files within a reasonable time, except records we must keep by law (such as invoices and payment records), and photos and video we captured, which we may keep in our own archive.
9. Accounts and acceptable use
Keep your login details private and let us know if you think someone else has accessed your account. You're responsible for activity under your account and for the people you invite to it.
Don't misuse our website or app — for example by trying to get around watermarks or access controls, interfering with the service, or uploading anything unlawful.
10. API access
If your plan includes API access, keep your API keys secret (on your server, not in web pages or apps others can open). You're responsible for what's done with your keys and for the systems you connect, including what they do with your photos and video — the same rules apply as in the app.
Use stays within your plan's limits. We may slow, suspend or revoke keys or webhooks that are misused, put the service at risk, or keep failing, and we may change the API over time (we'll give notice of changes that would break an integration where we can).
11. Liability
Nothing in these terms limits your rights under the Australian Consumer Law. To the extent the law allows, we aren't liable for indirect or consequential loss, and our liability for any purchase is limited to supplying it again or refunding what you paid for it.
12. Privacy
How we handle your personal information is explained in our Privacy Policy.
13. Changes and contact
We may update these terms from time to time; the version on this page applies from the date shown above. These terms are governed by the laws in force in Australia.
